1. Introduction

This Cookie Policy (“Policy”) describes which tracking technologies are used by Edilportale.com S.p.A. (“Data Controller”) when you interact with this website and with the various services provided through it (the “Site”).

To ensure the proper functioning of the Site and improve your browsing experience, store your preferences or track your online behavior, the Data Controller uses certain trackers that allow us to access and/or store information on your device, including some of your personal data (the “Trackers”).

The information contained in this Policy is provided pursuant to Article 13 of Regulation (EU) 2016/679 of April 27, 2016 (“GDPR”), Legislative Decree No. 196 of June 30, 2003 (“Privacy Code”), applicable national and/or EU regulations, as well as relevant interpretations on the matter.

The information in this Policy relates exclusively to processing carried out by the Data Controller through the Site’s Trackers and does not extend to processing carried out by third parties that may be accessed via the links below. 2. Data Controller and contacts

The Data Controller is Edilportale.com S.p.A., with registered office at via Natale Loiacono 20/b, 70126 Bari, Tax Code and VAT No. 05611580720, a company belonging to the Gruppo Mondadori – a corporate group consisting of the parent company Arnoldo Mondadori Editore S.p.A. and its subsidiaries pursuant to Article 2359 of the Italian Civil Code (“Gruppo Mondadori”).

3. Data Protection Officer (“DPO”)

Edilportale.com S.p.A. has appointed a Data Protection Officer (“DPO”).

You may freely contact the DPO for all matters relating to the processing of your personal data and/or if you wish to exercise your rights as set out in section 9 below, by sending a communication to dpo@edilportale.com.


4. What Trackers are

The Site uses certain Trackers, including software development kits (“SDKs”), which use unique identifiers to access and/or store information on your device. SDKs are collections of software tools and libraries that allow the Data Controller to integrate specific features into the Site. In some cases, these SDKs may install trackers such as cookies.

Cookies are small text files that the websites visited by the user send to the device used to access the Internet (usually the browser), where they are stored and then retransmitted to the same websites on the user’s next visit. Each cookie is unique in relation to the browser and device used to access the Site.


5. Personal data processed

Through Trackers, we collect and process data relating to your browsing on the Site such as IP address, device identifiers, operating system details, characteristics of the device used, pages viewed, date of access to the Site, and Tracker preferences.


6. Types of Trackers used

The Site uses:

  • First-party Trackers: placed on your device by the Site;
  • Third-party Trackers: placed on your device through the Site by selected third parties.

Additionally, based on their duration, Trackers may be divided into:

  • Session Trackers: stored for the duration of the browsing session;
  • Persistent Trackers: stored for a predefined period.

Trackers are generally distinguished based on their purpose:

  • Technical Trackers: these Trackers are necessary for the functioning of the Site and include both navigation Trackers (necessary for normal browsing and use of the Site) and functionality Trackers (which allow the Site to remember your settings, such as privacy preferences, in order to improve its services). The storage of these Trackers does not require your consent.
  • Profiling Trackers: these Trackers are used to track your behavior in order to create a profile of your interests and send you personalized advertising messages in line with your preferences. We may also share this information with third parties. The storage of these Trackers requires your consent. You are free to give, refuse, or withdraw consent to the installation of these Trackers via the consent banner displayed on the Site and/or through your operating system settings. Your preferences are recorded in a Consent Management Platform (CMP) provided by Iubenda, which acts as our data processor. The functionality of the Site will not be affected in any way if you choose to refuse consent to these Trackers.
  • Analytical Trackers: these Trackers are used to collect information about your interactions with the Site in order to optimize its services. The storage of these Trackers does not require consent when they are equivalent to technical ones.

8. How to manage your consent to Trackers

You can express your preferences regarding Trackers through the consent banner, which allows you to accept all Trackers, refuse them, or express granular preferences regarding Trackers that require your consent, such as profiling Trackers.

You can manage your Tracker preferences at any time by accessing the dedicated section for Tracker management, available via the “Cookie options” link in the website footer.

Your choices are stored for 12 months and recorded in the Preferences Register maintained by the Data Controller.

9. Your rights

At any time and free of charge, within the limits set by the GDPR and the Privacy Code, you may exercise the following rights against the Data Controller:

  • Right of access: you have the right to obtain confirmation from the Data Controller as to whether or not your personal data is being processed (or whether automated decision-making exists) and, if so, to obtain access to and/or a copy of such personal data (Art. 15 GDPR).
    With regard to exercising the right of access related to personal data processed through Trackers, please note the following:
    • you must extract from your browser the portion of the string corresponding to the technical cookie that recorded the consents given and provide this string to the Data Controller. The Data Controller, by inserting the “complete” string, will be able to query the Preferences Register in order to identify you and process your request.

    However, first of all, if you are not already aware of it, you may contact the Data Controller at the addresses indicated above to request the Cookie Policy ID relating to the Site or obtain further instructions and clarifications on how to perform the operations described below.
    After obtaining this ID from the Data Controller, you must browse the Site and use the browser’s developer tools to obtain the value of the cookie named _iub_cs-[Cookie Policy ID], where [Cookie Policy ID] is the ID provided by the Data Controller.

    Below, Chrome is used as an example, but the instructions are similar for all major browsers:

    1. Go to this Site
    2. Open the menu (three dots at the top right of the page)
    3. Click on “More tools” and then “Developer tools”
    4. Select the “Application” tab
    5. Click on “Cookies” and then on the item corresponding to the Site address
    6. Use the filter tool by entering _iub_cs (or _iub_cs-[Cookie Policy ID], if necessary)
    7. Copy the “Cookie Value” string
    8. Write to privacy@edilportale.com requesting access to your personal data, also providing the “Cookie Value” string.
  • Right to rectification: you may obtain the correction or completion of your personal data if it is inaccurate, partial, or incomplete (Art. 16 GDPR).
  • Right to erasure (“right to be forgotten”): under certain circumstances, you have the right to obtain the erasure of your personal data without undue delay (Art. 17 GDPR).
  • Right to restriction of processing: under certain circumstances, you may obtain restriction of processing (e.g., if you have objected to processing, exercised your right to rectification, and/or if processing is unlawful). In case of restriction, personal data will only be processed, except for storage, with your consent or for the establishment, exercise or defense of legal claims or to protect the rights of another natural or legal person or for reasons of important public interest. You will be informed before such restriction is lifted (Art. 18 GDPR).
  • Right to data portability: you may, at any time, request and receive all your personal data processed by the Data Controller in a structured, commonly used and readable format or request its transmission to another controller without hindrance (Art. 20 GDPR).
  • Right to object: you have the right to object at any time, for reasons related to your particular situation, to the processing of personal data concerning you. In case of objection, the Data Controller will refrain from processing unless compelling legitimate grounds prevail or for the establishment, exercise or defense of legal claims (Art. 21 GDPR).

To exercise all the above rights, simply contact the Data Controller or the DPO at the contact details indicated in sections 2 and 3 of this Policy.

You also have the right to lodge a complaint with a supervisory authority: without prejudice to the right to seek remedy in any other administrative or judicial venue, if you believe that the processing of your personal data is in violation of applicable law and/or your rights have not been satisfied, you may lodge a complaint with the Italian Data Protection Authority or another competent supervisory authority.


10. Where your personal data will be processed

Personal data will be processed by the Data Controller within the territory of the European Union. If, for technical and/or operational reasons, it is necessary to use entities located outside the European Economic Area, the Data Controller undertakes to ensure that the level of protection of personal data is essentially equivalent to that provided by the GDPR and EU data protection laws. Any transfer of personal data will be carried out in accordance with Chapter V of the GDPR, based on: (a) adequacy decisions of the European Commission; (b) standard contractual clauses adopted by the European Commission; (c) the adoption of binding corporate rules. In any case, you may request further details from the Data Controller.
